| Conditions
of License Agreement relating to the Chief Directorate: Surveys and
Mapping (CDSM) Data. |
|
Indemnity:
|
|
The
Licensee agrees to indemnify the CDSM, its employees, agents and
contractors in respect of all liability for loss, damage or injury,
which may be suffered by any person arising from that person’s use
of the Data.
|
|
Warranty:
|
|
The
CDSM does not warrant that the Data are free of errors. The CDSM
warrants that the grant of the license to use the Data does not infringe
the Intellectual Property rights of any person.
|
|
Ownership
|
|
The
CDSM retains ownership of the Data, whether in its original form or as
modified by the Licensee, and of the Intellectual Property rights
therein.
|
|
Commercial
Exploitation:
|
|
The
Licensee shall not Commercialise the Data or any product or service
derived from or incorporating the Data, unless it has first obtained the
written consent of the CDSM. The CDSM may grant or refuse its consent in
its absolute discretion and may grant its consent subject to any
condition or conditions whatsoever.
|
|
Law:
|
|
The
License shall be governed by and construed in accordance with the laws
for the time being in force in the Republic of South-Africa.
|
|
Application:
|
|
Where
the CDSM and the Licensee are agencies of the same Department in the
Government of South-Africa such that neither is permitted to enter
into a binding legal agreement with each other, then the License
Conditions stated herein shall be read as given rise merely to an
arrangement.

|
Copyright:
|
|
The
Licensee acknowledges that State copyright exists in the Data and in
derivatives of the Data. The Data may not be reproduced by any means,
without prior permission.
|
|

Whilst every effort is made to ensure the accuracy of this data,
